Autocultive operates as an online marketplace connecting buyers and sellers. We provide a platform for sellers to list products and buyers to purchase them. Autocultive itself is not a seller of products and does not take ownership of items sold.

3. User Accounts

• To buy or sell on Autocultive, users must create an account and provide accurate, current information.

• You are responsible for maintaining the confidentiality of your account credentials.

• You agree to notify us immediately of any unauthorized use of your account.

4. Seller Responsibilities

• Sellers must ensure their product listings are accurate, complete, and comply with all applicable laws.

• Sellers are solely responsible for order fulfillment, shipping, taxes, warranties, and customer service related to their products.

• Prohibited items (such as illegal, hazardous, or counterfeit goods) are not allowed on the platform.

• Sellers must comply with marketplace policies and guidelines.

• Sellers must include their shipping cost within the product price

• Sellers must provide valid tracking details after dispatch

5. Buyer Responsibilities

• Buyers agree to provide accurate payment and shipping information.

• Buyers must communicate promptly with sellers for any order-related questions or issues.

6. Payments and Fees

• Autocultive may charge sellers fees such as listing fees, commissions, or transaction fees. Fee details are provided separately.

• Payments for orders are processed securely via our payment partners.

• Autocultive does not hold or manage payments beyond facilitating the transaction.

• Refunds and returns are handled directly between buyers and sellers per the seller’s policies.

7. Order Fulfillment and Shipping

• Sellers are responsible for processing orders, packaging, and shipping within stated timeframes.

• Autocultive is not liable for shipping delays, damages during transit, or lost packages.

• Buyers should contact sellers directly for order status or shipping issues.

• Autocultive does not provide logistics services

8. Refunds and Returns

• Refunds, returns, and exchanges are governed by each seller’s policies.

• Autocultive is not responsible for refund disputes between buyers and sellers.

• Autocultive is not responsible for pickup failures, courier delays, or reverse logistics

9. Prohibited Activities

Users agree not to:

• List or purchase illegal, counterfeit, or prohibited goods.

• Violate any laws, infringe intellectual property rights, or engage in fraudulent behavior.

• Interfere with the marketplace operation or other users’ use of the platform.

10. Dispute Resolution

• Autocultive does not mediate disputes between buyers and sellers.

• We encourage direct communication between parties to resolve issues amicably.

• In case of serious violations or fraud, Autocultive reserves the right to suspend or terminate user accounts.

10A. Evidence Requirement for Disputes

To ensure fair resolution of return or refund disputes, both buyers and sellers are required to provide valid proof when requested by Autocultive.

Buyer Evidence Requirement:
Buyers must provide clear photo or video evidence showing:
• The received product,
• The issue being claimed (damage, defect, wrong item), and
• The condition of the package at the time of opening.

Failure to provide sufficient evidence may result in rejection of the claim.

Seller Evidence Requirement:
Sellers must maintain packing proof (photos or videos) taken before shipment and provide such evidence during a dispute.
Failure to produce evidence may result in the dispute being settled in favor of the buyer.

Autocultive reserves the right to make decisions based on the available evidence provided by both parties.

11. Intellectual Property

All content on the Website (design, logos, text, images) is owned by Autocultive or licensors and protected by law. Users may not copy or use content without permission.

12. Limitation of Liability

• Autocultive provides the platform “as is” and is not liable for any damages arising from transactions, product issues, or use of the Website.

• We do not guarantee the accuracy, quality, or legality of products listed by sellers.

•Autocultive is not liable for shipping delays, courier issues, or delivery failures

13. Termination

We reserve the right to suspend or terminate user accounts or access for violations of these Terms or any policies

14. Changes to Terms

We may update these Terms at any time. Continued use of the platform means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Assam. Any disputes shall be resolved in the courts of Assam.
